Needless to say they didn’t get any money from me b/c fortunately I had enough of a heads up to clear me bank account. can this credit card company still come after me for this debt? Has anyone ever had any dealings like this.
I disputed this on my credit report and faxed transunion a copy of the court papers saying they vacated proceedings and released me of garnishments and the have marked this account as paid on my credit report.
Being that i was released of garnishments i didnt know if that meant that i am clear even though they never accually got anything
Credit cards are unsecured debt. Check with all the credit reporting agencys and contact your state attorney general and/or the FTC!
it sounds like the credit card company went to court and received a judgment against you, IE the garnishment of wages as such if it is an active judgment , it will come back around some time and they may try to attach to assets by the credit card company or to a collection agency if they sell the debt
but in general as long as the credit card company re-certifies the judgment it will be good against you for a long time
It depends on the state you live in, and the statute of limitations there. The company is not supposed to come after you after the sol is expired. But, there is what is known as “zombie debt”, where the original debtor sells the debt and it keeps getting sold when it can’t be collected. And this can go on for years and years.
So save any related paperwork to the matter for the rest of your life. This is a new scam that companies are using to see who is too stupid to pay up.
